When someone harms another human in our country they become legally responsible for the injury they cause. This is true whether the injury was the result of an intentional act, like an assault, or if it happened because they were just being careless, as in most auto accidents. This personal accountability is the foundation of our tort system. We are all legally responsible for our actions. We inherited this law from the British over two hundred years ago. The act of injuring someone is referred to as a "tort".

Someone isn't paying attention while driving. Maybe they're on the cell phone, texting or looking at emails. Maybe they're late and can't find an address, frantically looking around for a street sign. For whatever reason they don't keep their eyes on the road ahead. Not paying attention while driving isn't just negligent, it's illegal and dangerous. Doing so can cause a collision. People can get hurt. Property can get damaged. Not paying attention makes you responsible for the other person's injury and property damage. Compensation has to be paid for the damage you caused.

An interesting article in the January Oregonian talked about a 3?year?old boy who was poisoned by eating tainted peanut butter crackers. Peter Hurly, the father of the boy, is a Portland policeman. His son fell severely ill for 11 days after eating salmonella-tainted peanut butter crackers. The peanut butter crackers were packed by a company called Peanut Corp. Congressional hearings recently revealed that the plant's machinery was filthy and not adequately inspected. In fact, the owner had complained that conducting salmonella tests were costing him money. It turns out he not only wasn’t testing his food products, he was ordering contaminated food shipped out to customers. In the words of the boy's father, "What he did was criminally negligent behavior, it was willful neglect and it just horrified me". As a consequence of his son’s poisoning, the father decided to take his message to congress.

A recent article in the Bloomberg News revealed that at least 28 percent of all United States traffic crashes are caused by drivers using handheld communication devices, such as cell phones. About 1.6 million crashes a year in the United States are caused by drivers using a cell phone or texting while driving.

The old adage "a picture is worth a thousand words" especially applies in auto accidents. Although doctors and lawyers know the damage to a car doesn't necessarily have much to do with the injury suffered by the occupants, the average citizen does not. They seem convinced that little visible damage translates into a very minor injury or suspect motives by the claimant. This is why pictures of both cars are very important to preserve. Car accidents often create a disproportionate amount of damage to the vehicles involved.
